CEDAR LAKE ESTATES HOMEOWNERS ASSOCIATION Fine Schedule and Procedures



WHEREAS, the Declaration of Restrictions for Cedar Lake Estates Homes Association, as amended from time to time (hereafter, "Declaration"), grants the Board of Directors of Cedar Lake Estates Homes Association ("Association") with the power to enforce all covenants, restrictions, easements, and changes contained in the Declaration; and

WHEREAS, the Board of Directors desires to promote the health, safety, and general welfare of all residents within the Association and to enhance and protect the value, desirability, and attractiveness of all property within the community known as Cedar Lake Estates by adopting guidelines and procedures to address concerns and complaints about the enforcement of the Declaration and its covenants, restrictions, easements, and changes;

LET IT BE RE SOL VED that the following covenant enforcement procedures will be followed:

1. Effective Date

These rules and procedures shall become effective 30 days after adoption.

2. Complaints

  1. The Board of Directors will investigate all Declaration violations reported in writing and signed by the complainant within 30 days of submission to the Board or the Association’s property manager.
  2. Complaints lacking sufficient detail, in the opinion of the Board, may be returned without further investigation.

3. Notification to Owners

  1. If the investigation confirms a violation, the Board will attempt to review the matter in person.
  2. If in-person review is not possible, the Board will issue a written notice via First Class Mail or Digital Service detailing:
  3. The nature of the violation
  4. Required corrective actions
  5. The owner must cease the violating activity within 5 days of receiving the notice.
  6. The owner may request a hearing within 8 days of the notice. The Board will hold the appeal meeting within 7 days of the request.
  7. If no appeal meeting occurs within 8 days, the matter is considered dropped.
  8. The Board’s decision following the appeal is final.

4. Fines

If no hearing is requested, or if the Board determines a violation exists after a hearing, fines may be levied as follows:

  1. 1st Offense: $100 fine
  2. If not corrected within 5 days, the fine may be reapplied weekly until resolved.
  3. 2nd Offense: $250 fine
  4. 3rd Offense: $650 fine
  5. Subsequent Offenses: $300 monthly fine until the issue is corrected, at the sole discretion of the Board.

5. Reset Period

Once a violation is resolved, any recurrence of the same violation after 60 days will be treated as a new violation.

6. Unresolved Violations

If a violation remains unresolved after notice or appeal:

  1. The Board may pursue legal or equitable remedies, including:
  2. Injunctive relief
  3. Monetary judgment for costs, damages, and attorney fees
  4. Fines reaching $1,000 may result in a lien against the property.

7. Amenities and Property Damage

  1. Property Damage: Violators are responsible for any damage caused. Punitive fines may be imposed at the Board’s discretion and used to enhance HOA properties.
  2. Pool Violations:
  3. Immediate suspension of pool privileges for the entire household pending investigation.
  4. Investigations must be completed within 7 days.
  5. Minor violations (no damage): Up to 2-week suspension.
  6. Major violations or property damage: Up to season-long suspension.
  7. Suspensions may be assessed during pool operation periods.
  8. Evidence Sources: Eyewitness accounts, social media, video recordings, etc., may be used in investigations.
  9. Formal Ruling: Must be issued within 14 days of the violation notice, including contact with all involved parties.
  10. Hearing Requests: Households may request a hearing within 1 week of the formal ruling.
  11. Board Communications: All communications (to households, community, or social media) must be approved by majority vote of the Board. No individual names shall be publicly disclosed.

ARTICLE VII – Construction, Improvements, and Alterations

  1. No exterior changes (paint, etc.) without Architectural Design Committee (ADC) written consent.
  2. Exempt items: Basketball goals, swing sets, temporary holiday decorations.
  3. Architectural forms on easyHOA app.




ARTICLE VIII – Restrictions

Temporary Structures

  1. No temporary living structures without ADC approval.
  2. Exception: family camping (short-term recreational use).

Signs

  1. House for sale/rent: 1 sign ≤ 32 sq ft.
  2. Open house: Allowed within 14 days of event.
  3. Political: 1 per candidate/measure (max 36x48 in), 90 days before / remove 2 days after election.
  4. Other events (garage sales, birthdays, etc.): 7 days before / remove 2 days after.
  5. Security signs: Allowed; use common sense on placement.

Unsightly / Unkempt Conditions

  1. Owners must prevent unclean, unhealthy, or unsightly conditions.
  2. Complaints to be reviewed for validity and severity; some issues may fall under city ordinances.

Storage

  1. No exterior storage in public view without ADC approval.
  2. Fuel tanks ≤125 gallons, screened from view.
  3. No unattached sheds (covered in Architectural Review)

Removed / Consolidated Sections

  1. Adverse Acts, Sound Devices, Power Lines, Fences, Sidewalks, Construction Requirements, Additional Structures, Antennas/Towers → now covered under city ordinances or other HOA policies (solar, fencing, architectural).

Swimming Pools

  1. No above-ground pools.
  2. All pools require ADC approval.
  3. Inoperable pools must be covered; no air structures/enclosures.

Livestock

  1. Only domestic pets allowed; no commercial breeding or kennels.

Garbage and Refuse

  1. Trash must be kept in sanitary containers (provided by the city). Trash containers should be stored inside the garage or behind an opaque fence or suitably opaque evergreen shrub that obscures the containers from view.
  2. Set out up to 24 hours before pickup / removed within 24 hours after.
  3. Exceptions possible with board approval (vacations, holidays).

Parking

  1. No long-term parking of trucks, trailers, campers, or boats.
  2. Utility and hauling trailers: up to 7 consecutive days within a 30-day period (7-days on-site storage max. per month)
  3. RVs, boats, campers: up to 72 hours within a 7-day period (3-days on-site storage max. per week)
  4. Work vehicles: one allowed if used weekly.
  5. Minor repairs: up to 48 hours; vehicle not on blocks.
  6. Longer exceptions require board approval.


CEDAR LAKE ESTATES HOA – AMENITIES RULES

(Not Part of Covenants – HOA Rules)

Swimming Pool

· Season: Open daily between Memorial Day and Labor Day, unless closed for maintenance.

· Access:

oA valid electronic pool key is required for entry and must be presented upon request.

oFailure to follow pool rules may result in revoked access privileges.

· Hours:

oMonday – Thursday: 7:30 AM – 10:00 PM

oFriday, Saturday, Sunday: 7:30 AM – 11:00 PM

o7:30 AM – 10:00 AM reserved for lessons, aerobics, and exercise.

· Safety Rules:

oChildren under age 14 must be accompanied by a person 18 years or older.

oResidents age 18+ may have up to 6 guests, and the homeowner must be present.




Clubhouse

· Smoking is NOT permitted anywhere inside the facility, including the entry hall and restrooms.

· Decorations:

oDo not use staple guns, hot glue guns, nails, thumbtacks, confetti, or glitter.

· Event Signage:

oAny signs or flyers used to announce or direct guests must be removed after the event.

· After Use:

oLock all exterior doors.

oTurn off all lights, oven, coffee pot, etc.

oSet trash outside in proper waste containers.

oVacuum and clean the rented area.

· Responsibility:

oThe renter accepts full responsibility for guests and any damage, loss, or removal of furnishings or property.




Pond, Playground & Walking Path

· Hours: 6:00 AM – 10:00 PM

· Use Rules:

oNo swimming or wading in the pond.

oNo boats allowed, except for maintenance.

oPonds and paths are for Cedar Lake Estates residents and their guests only.

· Prohibited Activities:

oNo littering or fireworks.

oDo not move, throw, or remove rocks.

oNo cruelty, mistreatment, or killing of wildlife.

oNo profane language.

oNo smoking or glass in playground or play areas.

· Pets:

oPet waste must be cleaned up anywhere in Cedar Lake Estates, including green spaces.

· Maintenance & Reporting:

oNotify the HOA Board of overgrown bushes, downed trees/limbs, or other issues.

oThe HOA Board is responsible for maintaining common areas.

oDumping of lawn debris on HOA property is prohibited.

· Vehicles:

oGas-powered motorized vehicles are prohibited on or near any Cedar Lake Estates common area (pond, green space, trails, playground, or pool).

oExceptions:

§ Approved official neighborhood business, maintenance, or special construction needs.

oRestricted vehicles include: Motorcycles, golf carts, gas-powered scooters, ATVs, Vespas, and mopeds.

oAllowed vehicles include:

§ E-bikes, wheelchairs, mobility scooters, other disability assistance devices, Power Wheels, and children’s play equipment.


Architectural Control Guidelines

(Updated November 2025)

Failure to obtain required architectural approval may result in fines and/or removal of the violation at the homeowner’s expense.




Guideline – Additional Structures

The HOA Board of Directors has approved the following guidance:

No mobile home, greenhouse, lean-to, shack, dog house, barn, rabbit hutch, outbuilding, machine shed, carport, detached garage, or any other structure shall be erected on any Lot.

Exceptions / Allowances:

· Play structures and swing sets (back yards only)

· Retractable clotheslines (back yards only; must be retracted nightly)

· Basketball goals

· Backyard fire pits

· Fountains and landscaping features

· Sheds attaching house with same building materials and color scheme.



Guideline – Antennas

· A single spire ham radio antenna is permitted if not visible from the front street elevation. Towers are not permitted.

· TV antennas (digital or analog) must be confined to attic spaces and not externally visible.

· Satellite dishes are permitted if not visible from the front street elevation.

· Devices installed prior to this guidance are grandfathered.

· Compliance required with Federal regulations and City of Smithville building codes.



Guideline – Decks, Pergolas, and Patios

All installations and replacements require prior approval from the Architectural Control Committee (ACC).

Decks

· Allowed materials: Pressure-treated lumber, redwood, cedar, or composite.

· Must not extend within 20 feet of any property line.

· Color must coordinate with the home’s existing exterior.

· Must comply with City of Smithville permitting and building codes.

· Any utility encroachment is the responsibility of the Lot owner.

· Must be properly maintained for structural integrity and aesthetics.

Pergolas

· Allowed materials: Pressure-treated lumber, redwood, cedar, or composite.

· May be attached or freestanding; must withstand wind and snow loads.

· Must not extend within 20 feet of any property line.

· Color must coordinate with the home’s exterior.

· City code compliance and maintenance are required.

Patios

· Allowed materials: Concrete, pavers, or decorative gravel.

· May be of various sizes and shapes.

· Any utility encroachment is the responsibility of the Lot owner.

Note: No exterior lighting shall extend beyond the boundaries of a Lot.




Guideline – Exterior Colors and Architectural Features

Any change to the exterior paint color or to architectural features—including shutters, doors, windows, gutters, downspouts, siding, chimney, or roof line—requires prior ACC approval.



Guideline – Fences

· Fencing is covered under City of Smithville ordinances.

· Homeowners are encouraged to discuss fence plans with neighboring Lot owners; report any disagreements to the Committee.

· Tie-ins with neighboring fences require written approval from affected owners.

· All fence designs and plans must be approved by the Committee before construction.

· Fences must be maintained to preserve structural integrity and appearance.



Guideline – Garages and Driveways

Covered under City of Smithville ordinances.



Guideline – Gutter and Downspout Replacements

· No approval required if type, size, and color remain unchanged from original construction.

· Any change in color or material requires prior Committee approval.




Guideline – Lighting

· No exterior lighting may be directed outside the boundaries of a Lot.




Guideline – Replacement Windows and Doors

· No approval required if shape, size, color, and design match existing installation.

· Replacements must be of equal or better quality than the original or current installation.



Guideline – Retaining Walls

· Retaining walls require prior ACC approval.

· Requests must specify:

oHeight, width, and length

oLocation

oMaterials and color

oDrainage plan

oCompliance with setback/build lines

oAny required building permits

· Changes to existing retaining walls also require approval.

· Must be maintained to avoid property damage or safety issues.

· Compliance required with City of Smithville building codes.




Guideline – Roof Replacements

· No approval required if shingle type, size, and color match the original or current roof.

· Vents, flues, flashings, and valleys must be consistent with the roof color.

· Box vents → ridge vents are allowed without approval.

· Rotary or bulb-type vents are prohibited.

· Materials must be equal or better quality than original.

· No cedar or shake shingles (fire hazard).

· Changes to roof hips, gables, or pitch require prior ACC approval.



Guideline – Renewable Energy (Solar Panels / Windmills)

· Must comply with City of Smithville codes, ordinances, and utility company requirements.

· No solar farms are permitted.

· Installations must blend visually with the home and neighborhood.



Guideline – Swimming Pools and Hot Tubs

· Above-ground pools are not permitted (except small portable toddler pools or decorative garden ponds).

· Hot tubs are permitted if not visible from street view and are properly maintained.

· Water discharge (backwash, draining, etc.) must remain on the property—no runoff onto adjacent lots or public/common areas.

· All installations must not present health or safety hazards.

· No exterior lighting shall extend beyond the boundaries of a Lot.
